Terms and Conditions

These Terms govern your organisation's use of ChalkItUp. By creating an account or using the service, you agree to these Terms. ChalkItUp is a business-to-business service — these Terms are between us and the gymnastics club, regional body, or other organisation that creates an account.

1. About these terms

These Terms and Conditions ("Terms") govern your use of the ChalkItUp platform, operated by Neil Winter trading as ChalkItUp ("we", "us", "our"). By creating an account or using the service, you agree to these Terms.

2. The service

ChalkItUp provides a web-based platform for managing gymnastics competitions, including entry management, judge scoring, live leaderboards, and results export. The service is delivered via chalkitup.co.uk and associated subdomains.

We reserve the right to modify, update, or discontinue features of the service with reasonable notice. We will not remove core functionality without giving you at least 30 days' notice.

3. Account registration

Accounts are provisioned by us following a request or agreement. You are responsible for:

You must provide accurate information when your account is set up. Each organisation must use a unique email address per user account.

4. Fees and payment

Fees for the service are as published on our website or as agreed in writing between us. We accept payment via Stripe.

Fees are charged per competition or by subscription, as applicable to the plan you select. All fees are stated inclusive of any applicable VAT.

Payments are due at the time of purchase or at the start of the billing period. Failure to pay may result in suspension of your account.

5. Free trial

New accounts may be provided with a trial period on limited terms, including a cap on the number of competition entries. Trial limits are displayed in your account settings. The trial is designed to allow you to evaluate the platform before committing to a paid plan. We encourage you to make full use of the trial before purchasing.

You agree to use ChalkItUp only for lawful purposes relating to the administration of gymnastics competitions. You must not:

You retain ownership of all data you enter into ChalkItUp, including competition details, gymnast entries, and results. We process your data to provide the service, as described in our Privacy Policy.

You are responsible for ensuring you have the appropriate lawful basis to enter personal data (including gymnast names and dates of birth) into the platform. You indemnify us against any claim arising from your failure to comply with applicable data protection law.

On account termination, you may request an export of your data. We will provide a data export within 14 days of a written request. Data is permanently deleted from our systems within 30 days of account closure.

8. Intellectual property

The ChalkItUp platform, including its software, design, and branding, is our intellectual property. These Terms do not transfer any intellectual property rights to you.

You grant us a limited licence to process and display your data solely for the purpose of providing the service.

9. Availability and support

We aim to keep ChalkItUp available at all times but do not guarantee uninterrupted service. Planned maintenance will be announced in advance where possible. We are not liable for disruption outside our reasonable control.

Support is provided via email at hello@chalkitup.co.uk. We aim to respond to support queries within 2 business days.

10. Limitation of liability

To the fullest extent permitted by law:

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

11. Termination

You may close your account at any time by contacting us at hello@chalkitup.co.uk. No refunds are issued for fees already paid (see our Refund Policy).

We may suspend or terminate your account if you breach these Terms, fail to pay fees, or if we reasonably believe your use poses a security or legal risk. We will give reasonable notice before terminating unless the breach is serious or urgent.

12. Governing law

These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

13. Changes to these terms

We may update these Terms from time to time. We will give you at least 30 days' notice of any material changes by email. Continued use of the service after the effective date of updated Terms constitutes acceptance.
